Мы не будем обсуждать в этой статье моральные аспекты использования ножей для самообороны. В конце концов, нанести серьезную физическую травму можно и более «невинным» предметом, оказавшимся под рукой. Гораздо более важной представляется юридическая сторона вопроса в части практического применения холодного оружия, к которому экспертиза запросто отнесет Ваш «сувенирный» клинок. Однако выбор за Вами, и кто знает, возможно, простенький на вид туристический ножик однажды реально защитит Вас или Вашу семью от чего-то страшного и непоправимого. Имейте в виду, что самооборона с ножом требует определенной психологической готовности - ударить ножом живого человека сможет не каждый. Кроме того, желательны все-таки предварительные занятия с инструктором.
У ножа есть свои плюсы (применительно к самозащите). Во-первых, ответственность за ношение при задержании минимальна. Во-вторых, лицензия на покупку не нужна, и, в-третьих, купить нож можно в любом гражданском магазине. Для городского ношения оптимальным будет компактный складной нож с клипсой или без.
Как выбрать нож для городских условий?
Нож должен быть прочным – раз, компактным и легким – два, комфортным для ношения – три. При покупке не стесняйтесь повертеть нож в руках, обратите внимание на форму рукояти и лезвия; для складных ножей обязателен фиксатор клинка и возможность быстрого открывания одной рукой. Не забывайте, что главное в ноже – клинок, сталь должна быть «породистой», даже если это изделие непонятого производителя под брендом «No name». Иначе это не нож, а бесполезная безделушка. Обязательно спросите у продавца сертификат (там указывается длина клинка, тип ножа и т.д.). Сертификаты и чеки лучше не выбрасывать.
К наиболее популярным простым моделям относится отечественная «Оса», достаточно надежная и удобная в обращении конструкция. Еще одна удачная российская разработка – ижевский нож «НСБ-2», практически вечный, долго не нуждающийся в заточке, одинаково хорошо рубящий дерево и стальную проволоку.
Серия так называемых «тычковых ножей для самообороны» в свое время пополнилась «Москитами» и «Оводами». Ножи дешевые, небольшого размера, для настоящего ножевого боя непригодные, но для самообороны использовать можно, если уж до этого дойдет. Минус – к таким ножам требуются ножны, что не всегда удобно.
Из заслуживающих внимания вариантов отметим тактические ножи скелетного типа, предназначенные для скрытого ношения (на ремне или на шее) – это американский MA-2/I, нож МА-2 немецкой фирмы Boker и другие аналоги.
Что считать холодным оружием?
Все ножи делятся на боевые, охотничьи, туристические, спортивные и хозяйственно-бытовые. Не забивайте себе голову измерением длины клинка, наличием гарды и кровостока, а также значениями твердости индустриальной стали. Относится ли конкретный образец к холодному оружию, сможет определить только криминалистическая экспертиза, так как единых критериев нет. Еще один важный момент. Если Вы нанесете нападающему серьезные телесные повреждения (неважно, каким именно ножом - канцелярским или боевым) и орудие нападения будет у Вас изъято, нож направят на экспертизу. Вещдок могут и не признать холодным оружием, но уголовное дело будет заведено в любом случае: по заявлению потерпевшего или на основе информации, поступившей из медицинского учреждения.
Ношение
Носить нож проще всего в наружном кармане, соблюдая простейшее правило: кроме ножа, никаких других предметов (ключей, бумажников и т.д.) там быть не должно, т.к. весь процесс извлечения ножа должен укладываться буквально в одно-два движения. Вариант с клипсой предпочтительнее – нож можно пристегнуть куда угодно. В общем и в целом носить при себе нож для самообороны нельзя. Это категорически запрещено законом РФ «Об оружии» (ст. 6) и может расцениваться сотрудниками полиции как нарушение. Но однозначных «Правил ношения» не существует. К примеру, при наличии охотничьего билета номерные ножи можно носить в сумке, рюкзаке, в любом другом месте, «исключающим доступ посторонних лиц».
Запомните как дважды два: если Вас задержат с охотничьим ножом, отвечайте, что Вы просто доставляете его из пункта А в пункт Б, и никакими нормативными актами подобная транспортировка не запрещается (не забудьте предъявить охотничий билет). С другими ножами (хозяйственными, складными) еще проще – а на работу носил, ибо ни один карандаш там не пишет, а точилку так и не купил никто… Убедили – хорошо, идите дальше и больше не попадайтесь. Не убедили, будьте готовы к тому, что нож заберут, направят на экспертизу, а там как повезет. Если признают холодным оружием, изымут навсегда, выпишут солидный штраф, а Вас как владельца возьмут на заметку.
Самооборона с ножом: что и как
Правило номер один: никогда не нападайте первым, словесная перепалка далеко не всегда переходит в драку. Правило номер два: в любом случае постарайтесь нанести противнику как можно меньший физический вред. В случае если от Вас требуют только кошелек и ничего больше. Отдайте. Если же Вы нарвались на пьяную компанию, напавшую ради куража, и понимаете, что живьем (в прямом смысле) Вас не выпустят, что ж, действуйте. Основными доступными точками поражения являются пальцы рук, запястья и предплечья. Однако повреждения рук нападающего переоценивать не стоит, для серьезной травмы нужен глубокий «профессиональный» разрез по профилю, а в уличных схватках обычно наносятся неопасные для жизни повреждения тканей предплечий, после которых противник не упадет в обморок, а станет еще более агрессивным.
Возможно, что шантрапа при одном виде крови перепугается и бросится наутек. Поэтому избегайте поражения жизненно важных органов, не трогайте шею врага, область печени и т.д. Понятно, что рассуждать и примериваться будет некогда, но все же постарайтесь сами как можно скорее выйти из конфликта. Пока противник разглядывает порезанный палец, разворачивайтесь и бегите. С несущественной травмой пострадавший вряд ли пойдет в медучреждение, поэтому инцидент не будет иметь для Вас правовых последствий.
Правило номер три: держите одного противника на дистанции поражения. Если нападающих несколько, выбирайте самого злобного – после нейтрализации «вожака» схватка, скорее всего, прекратится. При явной угрозе жизни немедленно контратакуйте, бейте, используйте секущую технику, нанося удары по разным уровням. Реально нападают 2-3 человека, остальные только мешают друг другу. Прикройте спину - сойдет забор, стена, все недвижимое, что окажется рядом. Нейтрализованного противника, в крайнем случае, можете использовать в качестве щита.
Конечно, без острой необходимости любое оружие лучше не доставать. Возможно, при самообороне Вам удастся обойтись подручными средствами и собственными кулаками. Но если вытащили нож, не выпускайте его из рук и не тратьте время на угрозы. Если нож перейдет в руки нападающих, Вам не поздоровится. Словом, защищайтесь, действуя по обстановке. И бог Вам в помощь.
Ответственность за применение ножа при самообороне
Как таковой ответственности за применение ножа нет. Суду (если до этого дойдет) все равно, чем Вы поразили противника – дамасским клинком или кухонным «хлеборезом». Важна только степень вреда, причиненного здоровью, вид наказания будет зависеть от инкриминируемой статьи.
При травмах легкой и средней степени тяжести дело может быть закрыто по примирению сторон, при серьезных травмах будет предъявлена ст. 114 (превышение пределов необходимой самообороны). Тогда Вы отделаетесь штрафом за ношение холодного оружия, условным сроком или общественными работами (но тут нужен хороший адвокат). При наличии доказательной базы не в Вашу пользу, можете пойти и по 111-й статье (умышленное причинение тяжкого вреда здоровью). Но в любом случае придется оплатить лечение потерпевшего – медицинское учреждение выставит счет не фонду обязательного страхования, а Вам лично.
И последнее. В запале уличной схватки при самообороне ножом можно потерять контроль над собой и «уделать» противника так, что он не сможет подняться с асфальта. Возможно, первым порывом будет желание сбежать с места происшествия. Сделайте выбор сами. Но, в любом случае, раненому человеку, будь он хоть трижды отморозком, лучше вызвать «скорую».
